held on to Gibsons portion of the cotton about 500 lbs, Gillespie denies that he can authorize Gibson or any one else to divide the cotton that he sent it to Mr. David Flowers gin altogether with instructions to gin it to gether and he intended to pay over to Gibson the ballance of his portion should any remain after this acct is deducted. There is no evidence of any thing like stealing on the part of Dr. Gillespie, his only offense if that be one is his holding on to Gibsons share of the cotton to save himself. I have no jurisdiction in the matter as a Justice of the Peace, Gibson if he desires to use legal means for collecting his cotton or the money, he must bring suit in the courts -
