Re: "Special Assignment of Colonial Pilots"

Dear Captain Clark:

In further reply to your inquiry regarding the validity of the "Special Assignments" made by Rad Janas on September 16, 1949, I would like to state that I have gone through the Colonial Agreement and having done so it is my opinion that these assignments violate the following provisions:

Section 7 (a) "When available, a regularly assigned first pilot or reserve pilot shall be assigned to all scheduled flights."

(In this case, Rad Janas took captains off bid-status and created a new type of assignment which is not contemplated in the Agreement and which was completely unnecessary.  You will recall that upon cross-examination before the Adjustment Board, Rad admitted he did not know why he took this action, except that "it seemed like a good thing" after he had talked to Branch Dykes.)

Section 8 (A)3 "All pilots ordered by the Company to duty involving circumstances of temporary or special nature shall be paid all necessary and reasonable expenses incurred thereby. . ."

(In my opinion, pilots placed on "Special assignment" are entitled to expense allowances over and above those granted else where in the agreement.)

Section 26 "Pilots assignments shall be classed as permanent or temporary."
