GITT vs. COLONIAL

In reply to your letter of September 6, 1949, Colonial would be willing to agree to the designation of a neutral to sit as a fifth member on the Colonial Airlines Pilots' System Board of Adjustment to heat the subject case.  You will appreciate, however, that this is a technical deviation from the provisions of the contract.  Therefore, sometime prior to the hearing of the case it would appear to be in order for counsel of the respective parties to execute a stipulation waiving the pertinent contract provisions insofar only as they may be applicable to the subject case.

Further, in this regard, I wonder whether we might agree on a neutral residing in the New York area who would be conveniently located and whose fee might be more reasonable than a neutral appointed by the National Mediation Board?  I would appreciate your ideas on this phase of the matter.

As to the constitution of the Colonial Airlines System Board of Adjustment, we would like to substitute at this time as the Company members on the Board, Mr. Branch T. Dykes, or vice president of operations, and Mr. T. J. Dunnion, our assistant to the President.  You will appreciate that Captain Janas and myself have presented the Company's position in the case in prior hearing and, consequently, we feel that it is in order to substitute other Company representatives on the Board.
