B. T. Dykes - Requested Mr. Schy to state the case.

Schy:  The pilot contends that certain provisions of the pilot agreement were violated by reason of the Company's failure to award a certain Bermuda run to the most senior captain who had filed a bid with the Company        pursuant to the bulletin posted on or about May 19, 1949.

Captain Gitt called as first witness.

Schy:  What date were you employed by Colonial Airlines, Inc.?

Gitt:  August 15, 1940

Schy:  Do you possess an Air Transport Rating?

Gitt:  Yes

Schy:  What date did you get your ATR?

Gitt:  June 1941

Schy:  On or about the 19th day of May 1949 did Colonial Airlines bulletin a vacancy on the Bermuda division?

Gitt: Yes

Schy: What was the expiration date of the bulletin?

Gitt: May 30, 1949

Schy: Did you file a bid:

Gitt: I did, on May 29, 1949

Schy: On May 29th what number did you have on the CAI Seniority List?

Gitt: It think it was No. 11

Schy: Did you have a conversation with G.R. Janas on or about the first of June?

Gitt: Yes, in the hall

Schy: To the best of your ability relate to the Hearing Officer what you said and what he said, in so far as this grievance is concerned.

Gitt: Another pilot and I were going down the hall from the hangar.  He said I see you bid Bermuda.  I said "Yes". He said "Well you realize you may have to go to Syracuse after you return from Bermuda".  I said that could be. Captain Janas said we can not let you have the bid for we have to think of the Company's side. If you get the bid we will have to train you and we do not wish to spend the money.  I asked him if that was the reason
