DENIAL OF EXEMPTION
Through his attorney, Donald W. Madole, James Wadsworth Furlow requested an exemption for a period of one year from the provisions of section 121.383(c) of the Federal Aviation Regulations to permit him to fly as a pilot in air carrier operations notwithstanding that he will reach his 60th birthday on October 27, 1967.

In support of his request, petitioner states: (1) that his latest physical examination was on February 13, 1967, when he met all qualifications for a first-class medical certificate; (2) that he is in excellent physical condition and is at a functional age which enables him to accomplish each and every requirement which the FAA has established for a pilot in command of a turbojet aircraft in scheduled air transportation; (3) that he will submit at his own expense to a physical examination by any physician or clinic designated by the FAA; and (4) that his record as an airman is exemplary, in that he has never been cited for a violation of a regulation and [[is]] never received an unsatisfactory grade on a flight check.

Petitioner discusses the "age 60" rule adopted by the FAA on December 1, 1959, and alleges that the reasons presented in support of that rule do not apply to him because he can continue to meet the prescribed physical and competency standards. Petitioner states that there is a current pilot shortage that would make it in the public interest to grant the requested exemption. Petitioner further states that he is well versed in the operation of his aircraft and can draw upon a wealth of hard earned experience which he states provides a higher degree of safety than a younger and less experienced pilot.
