Esq. Wake Co. Henry Smith complained that Orrin Smith abused and assaulted him - knocked him down injuring his head. The case was referred to the Civil Authorities. The man (Orrin Smith) was arrested by the Sheriff, and before the trial the parties settled the matter. According to Henry's statements Orrin Smith had always been his friend, and had helped him. Henry says he gave provocation for the assault upon him, and used very bad language, and threatened Mr Smith. Smith settled by allowing Henry to go on with his crops Is to let him have a Horse to furnish feed for the horse and Henry is to pay it out of his crop allowing the price he has now to pay for corn. If the horse is abused or ill treated Smith has the right to take him away. Henry on his part agrees that Mr Smith shall have the services of his boy for the use of the Horse. The case was dismissed upon the above settlement The parties mutually satisfied. H.C. Vogell. Agt Bu R. F & A.L. 106 271. Raleigh N.C. May 22nd 1868. Chavers Doctor. Wake Co. Mrs E.L.
