Respectfully referred to Maj. Wiley who will take prompt action in the case.

Respectfully returned with the information that the Brevt. Maj. Genl. Comd'g the Department has decided that the officers of the Military Police are not subject to the orders of officers on duty in this Bureau. It is not deemed advisable that they should seek to influence their appointment.

Continuation of endorsements. Endst. of Lieut WF Cox Asst. Supt. Sub. Dist Tarborg to whom the matter was referred for action. Respectfully returned to Major Aquila Wiley V.R.C. Supt. Central Dist Raleigh N.C. with the information that upon examination of this case I found that two of the within named children, for whose services the Freedman claimed $26.00, are quite small. The mother (Adeline) admitted that they worked but little. After making deduction for sickness I rendered judgment against Mr. Maggott for $65.00 which was paid the Freedman in my presence today, and which I think as much as the nature of the case demands.

Requests instructions in relation to the case of Lewis Marriott versus Amanda Hines who are living separate but both want the custody of their children. He also encloses a petition from Lewis drawn up by F.B. Phillips in which he gives the State law on this point.

In controversies between parents, living separate, for the custody of minor children the question will be decided with reference to the interests of the children. As the Freedmen are destitute of property this will depend on the habits, degree of inteligence, capacity for labor, and parental
