Affidavit of J.R. Greene citizen Orange County Says that on the 3rd day of May 1866, He received notice from Capt. Penniman to appear before him at Hillsboro May 13th/66 to answer complaint made by Saml Miller and being unwell at the time he received the summons wrote to Capt. Penniman requesting him to postpone the trial until he recovered sufficiently to attend the court.
Respectfully returned to Lieut Isaac Porter Asst supt Sub Dist Orange. A new trial is granted in this case. Give the parties fair notice and complete time to appear.
Report the case in the usual Weekly Report of Cases, stating in column of "Remarks" that this case was tried, judgment rendered and reported in the weekly report of cases giving proper date of trial and when reported.
