NARA 117 230 Hd Qrs Sub-Dist Raleigh Raleigh Sept. 20 1866 McAlpine T.D. Lieut V.R.C. and Asst Supt. 226, 227 235. Requests a guard for the protection of Rev. James Curry (Colored) Respectfully re-forwarded to Col A.G. Bready Supt. Central District with request that it be transmitted to the Commissioner at Washington for his action. The decision of the Asst. Com'r, in this case, is most respectfully appealed from and the following opinion submitted, 'That Genl. Order No. 102 dated War Dept. A.G.O. Washington May 31st 1865. does not leave it discretionary with District, Post or other Commanders" to furnish troops or not as they may elect, when a requisition is made upon them by an Officer of the Bureau. All responsibility in regard to whether the troops are needed &c is assumed by the Officer who requires for the troops. It is to be presumed that an officer on duty over Freedmen is better informed as to when or where troops are needed for their protection than an officer serving with troops who has nothing particular to do with Freedmen. When the within request for troops was made, I knew at once, from the character of the parties who made the report of the intended outrage and from the character of the neighborhood where the intended outrage was to be committed, that there would be trouble, unless measures were taken to prevent it. Although no troops were furnished, [[strikethrough]] to [[/strikethrough]] I went personally to the scene of the intended outrage and found assembled there, in addition to the Colored Congregation, a number of long-haired, guerilla [[guerrilla]]-looking white men who were there for the purpose of carrying the threats mentioned within into execution and who were only prevented from doing so, from an unwillingness on their part to assume the responsibility of killing an Officer. The emergency which caused me to require for these troops having passed, this paper is reforwarded simply for the purpose of ascertaining (over) 231 finally and conclusively whether it is optional with a District or Post Commander to honor a requisition made upon him, by an Officer of the Bureau for troops T.D.
