thousand, eight-hundred and sixty-seven, under color of his office as said agent, extort and unlawfully take from one Needham Whittey, a citizen of said State, and did compel the said Whittey to pay the sum of ten dollars as a fee which he falsely pretended was due him, said Wiseman, for approving certain indentures of apprenticeship made before the Probate court of said county. 
Specification 8th-In this, that he, Theodore Wiseman, agent of the Bureau for the relief of Freedmen and Refugees, being on duty as such agent at Hernando, in the county of De Soto, in the State of Mississippi, did at or near Hernando, on or about the first day of November, one thousand, eighthundred and sixty-seven, under color of his office as said agent, extort and unlawfully take from one L. Parsons, a citizen of said State, and did compel the said Parsons to pay the sum of ten dollars as a fee which he falsely pretended was due him, said Wiseman, for approving certain indentures of apprenticeship made before the Probate court of said county. 
PLEA.
To the 1st specification, "Guilty," except the words "oppressively and unlawfully," and the words "extort and unlawfully," and the word "falsely," wherever that word occurs.

To the 3d specification, "Guilty," except the words "unlawfully and oppressively," and the words "extort and unlawfully," and the word "falsely," wherever that word occurs.
To the 4th specification, "Guilty," except the words "unlawfully and oppressively," and the words "extort and unlawfully,"and the word "falsely," wherever that word occurs.
To the 5th specification, "Guilty," except the words "unlawfully and oppressively," and the words "extort and unlawfully," and the word "falsely," wherever that word occurs.

FINDINGS.
Of the 1st specification, The plea of the prisoner is confirmed with the exception of the word "unlawfully," and the Commission find the accused guilty of having unlawfully committed the acts specified, but not guilty of the specification, as they are of opinion that accused acted without criminal intent.
