2. David S. Harriman, Agent Bureau of Refugees, Freedmen and Abandoned Lands.

CHARGE.—Malfeasance in office.

Specification 1st—In this that he, David S. Harriman, Agent of the Bureau of Refugees, Freedmen and Abandoned Lands for Panola county, in the S ate of Mississippi, did at or near Sardis in said county, on or about the 14th day of November, 1867, unlawfully and corruptly accept and receive from S.H. Smith a resident of said county a sum of money, to wit: twenty (20) dollars as a consideration of his official services and action in a proceeding and suit which had immediately theretofore been in charge of said Harriman in his official capacity as such Agent, and in which said proceeding and suit said S.H. Smith had been then and there a party and interested therein.

Specification 2d—In this that he, David S. Harriman, Agent of the Bureau of Refugees, Freedmen and Abandoned Lands for Panola county, in the State of Mississippi, did at or near Sardis in said county, on or about the 15th day of October, 1867, unlawfully and corruptly accept and receive from James C. Shaw a resident of said county a sum of money, to wit: five (5) dollars and fifty (50) cents as a consideration for his official services and action in a proceeding and suit which had immediately theretofore been in charge of said Harriman in his official capacity as said Agent, and in which said proceeding and suit said James C. Shaw had been then and there a party and interested therein. 

Specification 3d—In this that he, David S. Harriman, Agent of the Bureau of Refugees, Freedmen and Abandoned Lands for Panola county, in the State of Mississippi, did at or near Sardis in said county, on or about the 5th day of October, 1867, unlawfully and corruptly accept and receive from Samual Peete a resident of said county, a sum of money, to wit: five  (5) dollars for on behalf of J. H. Keith, with the understanding that said sum was given for the purpose of corruptly influencing his decision in a prosecution against said Keith for assault, then and there pending before him in his official capacity as said Agent.

Specification 4th—In this that he, David S. Harriman, Agent of the Bureau of Refugees, Freedmen and Abandoned Lands for Panola county, in the State of Mississippi, did at or near Sardis in said county, on or about the 15th day of October, 1867, unlawfully and corruptly accept and receive from P. W. Miller a resident of said county, a sum of money, to wit: five (5) dollars as a consideration for his official services and action in a proceeding and suit which had immediately theretofore been in charge of said Harriman in his official capacity as said Agent, and in which said proceeding and suit said P. W. Miller had been then and there a party and interested therein.
