HEADQUARTERS SECOND MILITARY DISTRICT, Charleston, S. C., April 4, 1868. GENERAL ORDERS,} NO. 58. } I. Before a Military Commission convened at Camden,S. C., pursuant to paragraph V, Special Orders No.54, current series, from these Headquarters, and of which Brevet Colonel JOHN R. EDIE, Lieutenant-Colonel 8th Infantry, is President, was arraigned and tried: Isaac Owens, citizen. CHARGE-"Murder" Specification 1st- "In this, that he, Isaac Owens, resident of Kershaw District, South Carolina, on the twelfth day of January, in the year of our Lord on thousand and eight hundred and sixty eight, at and in the District of Kershaw aforesaid, in and upon one William Mickle, a person of color, feloniously, willfully and of his malice aforethought did make an assault; and that the said Issac Owens a certain double barreled shot gun. then and there charged and loaded with gunpowder and leaden bullets, which said double barreled shot gun he, the said Isaac Owens, in his hands then and there had and held, then and there did discharge and shoot off one barrel of said double barreled shot gun. to. against and upon the said William Mickle; and the said Isaac Owens, with a portion of the leaden bullets aforesaid, out of one barrel of the double barreled shot gun aforesaid. then and there by force of the gunpowder aforesaid. by the said Isaac Owens discharged and shot off as aforesaid, then and there did strike, penetrate and wound the said William Mickle, in and upon the abdonmen of him the said William Mickle. giving to him the said William Mickle, then and there on mortal wound; of which said mortal would he, the said William Mickle languished about two hours and then died. And so the said Isaac Owens the said William Mickle, in the manner and by the means aforesaid. feloniously, wilfully and of his malice aforethought did kill and the murder, against the peace of dignity of the State of South Carolina and of United States of America. All this in the town of Camden, Kershaw District, South Carolina, on or about the twelfth day of January, 1868." Specification 2d- "In this, that he, Isaac Owens, resident of Kershaw District, South Carolina, on the twelfth day of January, in the year of our Lord one thousand eight hundred and sixty eight, at and in the District of Kershaw aforesaid, in and upon one York Owens, a person of color, teloniously, wilfully and of his malice aforethought did make assult; and that the said
