enclosing a "Certificate of Insurance," of which a copy is attached here to as Exhibit B. I did not receive any other certificate of insurance coverage for The Mural while at the Gotham.

5. The Gotham failed to give proper protection to The Mural while in its custody and permitted it to be misused, as a rack for hats, coats and other garments. The Mural suffered substantial damage as a result of such mistreatment and required several days' work by me to restore it to suitable condition for exhibition at the Stable Gallery.

6. In February 1964, the Gotham Hotel returned The Mural to me at my request for the purpose of exhibition in my show at the Stable Gallery. Neither then nor at any previous time did the Gotham mention its  purported options to me.

7. At no time prior to the sale of The Mural to Mr. Abrams did I inform him or Mrs. Ward of the existence of Exhibit A or of any option or purported option given to the Gotham Hotel for purchase of the The Mural.
