Endorsement on Communication from R.L. Rhodes, dated Georgia R.R. Augusta, Ga. Jan'y 23d 1866, enclosing forty six (46) orders for transportation issued under the auspices of the Freedmen's Bureau, which, he states, contain defects which he requests may be remedied and returned to him.

Respectfully returned - attention is invited to the fact that S.O. No. 138, W.D. A.G.O., is dated Sept. 16, 1865, and is

given by authority of the President of the U.S., and cannot be modified by any inferior authority even of a later date; whereas G.O. No. 17, Par. 12, Q.M. G.O., Match 16, 1865, is of a prior date. In making requisitions for transportation, I have exactly and scrupulously complied with G.O. No. 138, before referred to, which describes the class and condition of persons not in the Military Service to whom transportation may be given - therefore fulfilling the Par. 12, G. O No. 17, from Q.M. G.O aforesaid. 

It is not in the province of Capt. S.B. Brown, A.Q.M., to refuse to pay these vouchers, which are properly made out and perfectly good. Please send them to him with a copy of this Endorsement; and, if he refuses to pay them, make the fact and the ground of his refusal known to this office, and the attention of the Sec'y of War will be called to the matter.

Endorsement on Communication from Nelson Bronson, 1st Lt. & A.A.S. Com'r, dated Savannah, Ga. Jan'y 22d 1866, relative to the resignation by Judge D.A. O'Byrne of his office as Ag't for the Bureau R.F. & A.L. for Chatham County; and his supposed reasons therfor:

Respectfully referred to Brevet Maj. Gen. Brannan, Comd'g Dep't of Georgia, with the request that he will instruct Col. Kimball, Comd'g at Savannah, to investigate the matter within referred to and report the facts. 

It would seem as if Lieut. Bronson had acted hastily, and that Mr. O'Byrne is not in fault; but that the instructions of the Chief of Police were in violation of the understanding the undersigned had with his Honor the Mayor, that all cases in which freedpeople were parties interested should be brought before Judge O'Byrne for his disposal.
