by the defendant for the witnesses "Thomas B Grayson, James Payne, P. M. Bailey, William Starley, A.C. Love & W.T. Watson", which subpoenas were returned by the sheriff as executed upon all the witnesses  

On the 11th day of March 1867 the Defendant filed the following application for a continuance 

The State of Texas 
Freestone County 
District Court Spring Term 1867

The state of Texas vs W A Milner 
Manslaughter.

Now at this term of the court comes the defendant W. A. Milner and says that he cannot go safely to trial in the above entitled cause at the present term of the court for the reason here after set forth.

1st Defendant says that the occurrence that led to the death of the deceased P.L.C. Davis took place only two days before the convening of the present term of the District Court and that it has produced a very considerable excitement in the minds of the people of Freestone County and a very great prejudice against him, that said deceased was connected with a large and influential family of relations
