4- A Soldier of Capt Smith's Command Co "E" Third Bat 17th Inftry shot in the streets of Brenham by one Wyatt - no action by Civil Authorities except to indict the Commanding Officer for disturbance, growing out of an attempt to arrest the outlaw, by the Military - occured Sept. 1866-

5 Another of Capt Smiths men wounded at the same time - same remark as before.

These are believed to be the five soldiers referred to by Capt Craig, In making enquiries I have learned of the following additional assaults & murders.

6 A discharged Soldier named Kupp shot in the streets of Brenham by one Garrett - sham civil trial and acquittal - occured in fall of 1866-

7 An Officer on his way from Austin shot by a party of gamblers led by one Holt in the Summer of 1866,- no action by Civil Authorities

8 A "Mustered Out" Officer Killed by one
