of any one till about a week or Ten days, when Jas W. Page, father of Ed. Page. came to him witness & requested him witness to go with him Page before Philip Howard Sub. Asst. Com. in Bosque Co., to have the matter investigated, having heard that his son, Ed. Page, with Dallas Kelly, (who was in his employment) were accused, or rather suspected of being guilty of the shooting of Lewis Abby F.M.C. They went to the said Philip Howard, Sub. Asst. Com. & made known their request, whereupon the said Howard declined investigating, stating there was no complaint made, only idle rumor, but for their satisfaction appointed the following Monday, on which day to give the matter a hearing. Before the said following Monday, the Brazos river was up so they could not cross. But on the following Friday he, the said witness Winter, called in the said Howard to explain the reason of their absence on Monday, when little or no reply was made by the said Howard.

Also stated that the said Dallas Kelly was about starting to Louisiana, but heard said Kelly state that he would rather die than leave with such a rumor behind him.
