other witness state that I said I was the law and so forth = I had to obey my orders which was a military law of which the people generally do not know, I never assumed my power more than was granted me by my orders and where my orders do not cover every imaginable case I am left to use my discretion, subject to the approval of the Assistant Commissioner of Texas; this was what I conveyed - still I was misquoted and probably misunderstood ----

During the time the examination was being conducted by Capt. Bradford, this J.C. Miller attempted the life in open day of Col Cooper, by assaulting said Cooper with a six shooter.  Capt Bradford ran up and disarmed Miller, and turned him loose Col Cooper is a good Union man and gave Miller no cause for this assault, only Col. Cooper was assisting me in taking down evidence before Capt. Bradford ---

I attach to this statement seven affidavits taken after Capt. Bradford left, because he could not stay longer to investigate the affair  These will show that I was not intoxicated that the citizens fired upon my guard - and that they followed me next day to take my life - also the citizens names who fired &c &c.  Also I attach to this report a petition of 299 citizens of Houston Co. who wish me reinstated at once ----
