& should not leave. about 10 or 11 oclock Mr. Ira Harris Town Marshall arrested me on a warrant from Mr W. J. Darden Mayor & took me before him whereupon Mr Darden ordered me to jail until my witnesses should be brought This Mr Harris did not do. At 3 oclock I appeared before the Mayor & stood my trial & was held to bail in the sum of 1000$ to appear at the District Court on the charge of "an aggravated assault on the person of James Moore f.m.c. a policeman of the town of Columbus on the evening of Decr 13th 1867" an offence of which I am not guilty never having struck him as was testified to by all the witnesses who appeared at the trial before Mr. Darden excepting James Moore viz: Wm. M. Smith, James Sherrill, Isam Tooke Jr & Wm Howall white person & Sigh Howell colored
