be commenced; unless the party applying for such process, his agent or atterney shall make oath that the party so applying is unable to give such security. And article 1203 provides that when a party shall make oath in writing before a Justice that he is too poor to pay the fees, he shall have all necessary process and a trial of his cause free of costs

Any justice of the Peace who violates these laws ought at once to be removed from office
