that the previous settlement was made with the understanding that the Admr. had been administering with the Will annexed, which proved not to be the case.  Mr. L.D. Hearne & bondsmen were accordingly directed to report to me at Sterling for settlement.  I exhibited to them the accounts and stated that they had been disapproved at Hd. Qrs., and the amounts checked ordered to be paid.  This they refused to do, and Lt. Kirkman ordered me to take them under guard to Austin to be tried before a Military Commission.  Finally a compromise was effected, and H.R. Hearne, one of the bondsmen, paid over to me One Thousand Dollars in specie, in compliance with the following instructions:
