arrangement about the corn.  That he did not set apart and divide the corn - at that time nor at any time thereafter, does not know whether the corn was ever set apart to the freedman after that time or not nor does not know what arrangements if any was ever made after that time between Capt Miller and Jesse Brewer.
Witness knows that a very considerable quantity of corn was wasted and destroyed on said plantation after it was gathered by stock - for the want of proper attention.

5th The freedman (name not recollected) upon being asked by consel for the defendant - made the following statement - that he came to Bryan on or about the 28th day of December 1867 - to see Capt Miller about the corn
