R.J. Wheat, residing at Wheatville, sworn testifies: "Jo. Brisco was at the store house of Wheat & Co at Wheatville; it was in the spring of 67, and I asked Jo how he liked his new home; he said that he was not well pleased, and that if a contract did not exist between him and Dr. Beale, he would not stay there. He did not state where he wanted to go to. He did not say that he liked his place with Dr. Beale."

C. J. Clark, lives on White Oak near Wheatville, sworn: "It was this spring I asked Jo. Brisco how he liked living with Dr. Beale; he said he did not like to live over there. He said Dr. Beale had promised to put him on open land, but that he had not done it. Jo said that he intended to leave Dr. Beale."

W. J. Boggs, lives near Wheatville, sworn: "Did you hear any conversation between Mr Hart and Susanna about three weeks ago?"
Answer:- "I heard Susanna say that she was not forced away from Dr. Beale's; that she come away of her own account. Susanna was at Mr. Hart's house when this conversation took place."

Sylva Brisco, freedwoman, lives with Mr. Hart, have lived with him a year, sworn:
