knew one of these four men; that he knew his name and that his life would be taken if he informed on him. Smith, after cooking supper for these four men, guided them to the ford of Cypras river in the direction of my cabin. Mr. John Jones & his sister, while living in the same neighborhood while passing Smith's house Sunday evening the 16th instant, saw these four men at the Smith's house and asked Mr. Smith who they were: Smith told them they were travellers getting supper. Smith told Hammuck, a neighbor of Smith's who stopped at his (Smiths) house Sunday night, 16th inst, that these men were from Gray Rock & had come for him, Smith, to play the fiddle at a party and that he was going to show them the way across Cypress. Walter Skinner, white, living in the neighborhood of Mr Curlocks saw these men: I described two of them to him; he said it was their exact description, that he had seen them on Sunday. Two of the men I can swear to; my wife says that she can identify them all if she should see them again. One of the men was a spare, tall man, black hair & a short, thick beard, no whiskers or mustaches. An other was a short, heavy built man, full red face, with sandy hair & mustache. My wife says that this short fat man had his face badly scratched, as if he had been fighting; they took a five shooter pistol from over my cabin door, and told me I might go to Mr. Pleasant and report them; that I would never live to reach there.

Sworn and subscribed before me at Mount Pleasant, Tex, this 22nd day of Feb'y 1868.
