The State of Texas }
County of Titus }

The evidence of M M D Moz of Titus County - taken on oath at Mount Pleasant in said county on the third day of March AD 1868 before Saml Boynton a Justice of the Peace in and for said county and also before the Jury then and there sworn to enquire how Sergant Clem H Pearson then and there lying dead came to his death_ is as follows to wit, on Sunday the 3rd March I went to Chambers and he brought some freight up. After we had put the freight in the House, we sat down and had a conversation relating to some freight he Chambers had in my grocery house at Dangerfield, and after we had been talking some time, Mr Pearson came in and took a seat [[strikethrough]] at first [[/strikethrough]] with us. We conversed some twenty minutes about that time, almost two Oclock I dont recollect Mr Chambers said I believe I will go, and went out at that time Mr Pearson inquired if I had some cheese.  I went behind the counter to get the cheese for him. When I was opening the Box to get the cheese the man English came in the back door of my place - the front door being shut Mr Pearson was standing opeset me as English came in, I Said to English how dedo English, Mr Pearson Said is that English the damded desperado, English began to walk backward and Said no my name is Smith. (and I wish to remark before proceeding any further that a freedman named Meksten steped in - just before English did) as English began to walk backward, Pearson advanced on him English went out of the door, backward, and Pearson following, I was afraid to go to the door, and had no arms,
