Gentlemen,
Will you please give me your legal opinion, in regard to, whether or not,is a sheriff authorized by the law, to arrest a party upon the verbal order of a Magistrate given outside of Court, and if so under what circumstances. I refer to you also, Gentlemen, for your legal opinion, that portion of the Affidavit of Jno M Bearers, W H Horton and DW Barner, in regard to what was done in Capt Hortons office, and ask if I had any authority under the law to execute the order of Justice Bearers given under the circumstances as stated, and also, when the County Court is in session, is the Sheriff the officer of that Court, or must he act as Baliff or Constable to the Magistrates Court and which of the laws has precedence in its authority to Command his attention and review.
