In reply to your note of date yesterday, asking our opinion upon questions therein stated; we have to say 
1st it is the duty of the sheriff to execute all processes and precepts directed to him by legal authorities and make return thereof to the proper court. Per Dig Art 5115 the sheriff is a conservator of the peace in his court and it his duty to arrest all offenders committing violations of the law of the state in his presence or hearing Ib Art 5114.

Magistrates are peace officers, and may arrest or order the arrest of any person committing a breach of the peace, or making an attempt to inflict all injuries upon the person or property of another in his presence. This may be done either by verbal order to a peace officer, to reinforce and prevent the injury, or by seizing an order of arrest, or by arresting the offender himself for which purpose he may call upon all
