I have the honor to report the case of Randolph Jones a Freedman of this county charged with grand Larceny and tried before the circuit court at this place on wednesday the 2' inst

I do not think the facts proved will justify the finding of the jury for the following reasons. 

1st The indictment charges that the Prisoner did feloniously take steal and carry away six hogs the property of Blair Burwell of the value of one hundred and twenty dollars ($120.-). The facts proved do not show that the Prisoner had any thing to do with the six hogs of Blair Burwell or any of them

2' It is shown that of the meat found in the possession of the prisoner that which had been last killed could not have been killed over three days when the last lot of hogs missed by Mr Burwell had been [[strikethrough]] been [[/strikethrough] gone seven days. hence a doubt might arrise as to the identity of the meat with the three hogs last missed by Mr Burwell, and I am of the opinion that the prisoner should have the
