"Grand Larceny"

Be it remembered that on the trial of this cause the Prisoner by his Attorney moved the court to set aside the verdict rendeered and grant him a new trial on the ground that the verdict is contrary to the evidence, which motion the court overruled, being of opinion that it was a proper case to be left to the jury and having instructed the jury that to convict the Prisoner they must be satisfied from the testimony that the meat found in his possession was part of the hogs lost by Blair Burwell and that the said Hogs had been stolen by the Prisoner, to which the Prisoner by his Attorney excepted and tendered this his bill of exceptions and certificate of the following facts proved. That about the first of November 1865 on Saturday morning the Hogs of Blair Burwell twenty-eight (28) in number were turned into a large field near the residence of one Edward Taylor. On Tuesday following the Hogs were taken out of the field and it was then discovered that three of the number were missing. About three weeks thereafter, some-
