the Court, that Mr. Clarke agreed to pay the several sums affixed to the names in Doc. markd B. for the Month of May which agreement was made in the presence of Lieut Smith of the 6th Corps then on duty at Scottsburg. There was no attempt made on the part of Mr. Hudson to disprove the claim. 

On the 1st of June 1865, Mr. Clarke made a new agreement with his hands for the balance of the year, at the close of the year he settled with most of them but refused to pay them for services in the Month of May allthough according to all the evidence adduced he made the agreement with them as before mentioned 

I notified Mr. Clarke through his agent Mr. Hudson of the decision of the Court, which was that the claims were Just and must be paid. I heard nothing in regard to the matter untill April 17th when I received the Document enclosed Markd A not considering it official I awaited untill I should hear from Hd. Qrs. in regard to the case. Receiving no notice of any appeal from Hd Qs on May 14th I placed the account, Doc. B. in the hands of a constable for collection Mr. Clarke then being in this County payment was refused and on the following day I received the communication
