Charge 1st     Murder.
Specification   In this that the Private John Delaney Co. "A". 5th Regt U.S Artillery did without cause or provocation and not being in the line of duty shoot to death with his revolver one William West a colored citizen of York Co. Va. This at or near Fort Yorktown, Yorktown York Co. Va. on or about sunset of the thirtieth (30th) day of March 1867.

Charge 2   Conduct to  the prejudice of good order and military discipline.
Specification   In this that he Private John Delany Co "A" 5th Regt. U.S. Artillery did without cause or provocation shoot his revolver into an assemblage of unoffending "Freedmen" or colored citizens of York Co. Va thereby, endangering their lives.  This at or near Fort Yorktown, Yorktown, York Co. Val on or about sunset of the thirtieth (30th) day of March 1867.
