authority to make such a division, that Gen'l Miles' order gave each of said parties, an undivided half, and that whichever occupied the building - the other party would be entitled to half rent, that Cap't W - continued his occupancy until subsequent to Oct 1st ensuing. In addition to rooms of Capt W -. several gentlemen in the employ of the Bureau, some with families, were also domiciled at the same time in the building, from which facts he has always felt warranted in supposing that the Bureau was responsible for said occupation by its employees. Has allowed persons to live in the Building, at different times to protect it from depredation.

There has never been, on the part of the loyal owners, any occupancy of the building (i.e. in the sense of deriving benefit from such use.) with the single exception that during a few months of last Winter, one room was occupied as a schoolroom, free to all who could not pay for their tuition.

Report of Board: State that no valid claim, upon facts aduced before said Board, can be made, but in view, that no "commutation of Quarters" was paid to Col Whytal, during his occupation of the building, they suggest that an amount be allowed not exceeding one half of the commutation actually saved by the Government, I.E. $40.50.
