In answer to the question "Was the deceased Drunk" The witness said he did not know, he talked "mighty straight" but he said he saw him drink 1 1/2 pints of whiskey — and did not know how much more.

When Tallaiferro ordered him to leave the place he said he would not without getting his rights  Then Tallaiferro threatened to kick him off. Witness says they "jawed" a little and Mr Tallaiferro picked up a piece of pine about a foot long and about as round as his wrist, and threw it at Hudson being three or four yards from him — the stick struck Hudson on the temple — not knocking him down, but Hudson put his hand to his head, Hudson not leaving then, Tallaiferro went into the house for his gun, but Lewis (the witness) met him in the door way and made him put down the gun, that Hudson was going away   Witness said the gun was not loaded.  

In answer to the question  If he thought Hudson was severely hurt, or that Tallaiferro intended to kill Hudson, witness said he did not think so.

There was a Cold boy examined but he did not know much, he drove the cart away, and testified that Hudson went to a swamp to wash off the blood, and then laid down on the side of the road while witness went to the Mill, when witness came back he took Hudson to his (Hudsons) home in the cart.  Hudson died next day at about 9 A.M. - (The affair took place at between 5 and 6 Oclock the evening previous)

There was a Coroners Inquest, and the verdict
