facts which you already have, as well as call your attention to his testimony in the case.

You will bear in mind that he stated on oath that the horse belonged to the U. S. & that he laid no claim to him. In his testimony, he admitted the truth of all the plantiffs charges except; that he acted as a Magistrate in the matter, & did not receive the money and watch as compensations. He further stated as a reason for not letting Mr. Wallace have the horse that he could not spare him. 

When I notified him that I had orders to take the horse, his reply was that he was sorry, as it would break up his team, and in almost the same breath said the Government ought to pay for keeping the horse as the horse had been no use to him!!!

On several occasions Mr. Martin stated to me that he did not want the horse, that he had no use for him. I would respectfully ask, that no revocation of the order be made without a full review of the testimony as I regard his course in the case as a piece of petty tyranny toward Mr. Wallace, & in all respects unworthy of a Magistrate, to say the least.
