I said to Mr Tracy that I could do it but had not said yes that I would do it, that I thought the security was good which I was I knew — and that I thought that if that was required that he ought to have said so before He ought to have made the objection before he received the bonds. I then told him I would take it to someone who knew more about it than I did, and if they said sign such an article I would do it. All this time Mr Tracy had the bonds. I then took this agreement out to Middleburgh showed it to lawyer (Nolan) & stated the circumstances to him At the time I had a copy of the bonds in my pocket which I had written off. He look of the agreement and the copy of the bonds and told me not to sign such an agreement as that, that it was one of the most absurd things he ever saw. I then asked him what I must do in regard to the matter. He told me to go & take possession of the mill if I could peaceably, if not by force. This was on Monday as well as I can recall it. Mr Tracy was in the mill grinding I went in the first place to the storehouse where there was a fire. My miller was in there warming, I asked him why he was not in the mill, Why Mr Tracy was in the mill.
