I have the honor to report the following case, in which a freedman was concerned, tried by me as Mil. Com'r for the town of Winchester, with my action therein, as follows:

Sept. 17th  P.W. Emerson, charged with committing assault and battery upon Albert Brown, freedman-

Accused plead guilty and was fined $3.00 - In this case application for a warrant was first made to Mr Burnside, a Magistrate, who excused himself from acting, stating that his partner was away, and he being alone in his store could not spare time to attend to the case - Then to Mr Miller Magistrate, who excused himself on the ground that it was properly a case for a Corporation Magistrate.

The Mayor and Recorder were both out of town -
