a Canteen; that he never saw Hatchell on that night; saw him on the following Monday at Chuckatuck; that he and Richard Wooden and John Edmonds went home and staid there all night; that they were home at nine o'clock; that he had taken Hatchell home when he was drunk; had frequently done things for him on his place; never had any difficulty with Hatchell (except the case mentioned by Hatchell in his evidence).

John Edmonds and Richard Wooden were sworn and their evidence was substantially the same as that of Sandy Wooden.

Sophia and Suckey the wife and daughter of Sandy testified that the three men came home that night about nine o'clock, and that they had all slept in the same room with them, and that none of them were away during the night.

Albert Powell (white) testified to the good character of Sandy Wooden. 

You will perceive by the above evidence that Hatchell swore that he was taken out of his house about ten o'clock on the night of the 7th day of July 1866, took a drink out of a bottle, and then
