W. Scott, John J. Chenault, Summerfield Dance, John J. Allen, Nathaniel Young, Winfield S. Berry, and Beverly S. Scott, who were selected and drawn in every respect as is provided by law for obtaining Juries in Criminal cases, who being sworn the truth of and upon the premises to speak and having heard the evidence, upon their oaths do say the said Joe Bell is guilty of the burglary in manner and form as in the Indictment against him is alleged, and they do ascertain the term of his imprisonment in the Penitentiary to be Five years. And it being demanded of him if any thing for himself he hath or knew to say why the court should not now proceed to pronounce judgment against him according to law: the said Joe Bell moved the Court to set aside the verdict of the Jury and award him a new trial, which motion was overruled, to which opinion and action of the court the prisoner excepts, and prays the court to sign, seal and enrol his Bill of exceptions and to certify the facts proved on the trial, all of which was accordingly done, and the same is made a part of the record without being herein copied; and nothing further being offered or alleged in delay of Judgment. It is considered by the court that the said Joe Bell be confined in the Penitentiary for the term of Five years the period by the Jurors in their verdict ascertained. And it is ordered that the Sheriff of this County do as soon as possible after the adjournment of this Court, remove and safely convey the said Joe Bell from the Jail of this Court to the said penitentiary therein to be kept and treated in the manner directed by law, and the said Joe Bell is remanded to Jail.
