This man Simeon Cumby was living at a mill had never owned a horse, since I had known some 3 or 4 years, and had never lost anything by either army, in any way whatever. his son who was living in the house with him had several horses in his possession, which were reported as "taken up" and to whom I am pretty sure, I gave authority to hold one of said horses until called for by the U.S. Government.

Simeon Cumby came up to the C.H and delivered up one horse, and I having an application from Tho's R. Marshall, through his son, who was then present, the horse was immediately turned over to him
