Record of Proceedings in the case of Harris and Smith, Freedmen, vs. James Lacy, as to the title and ownership of a certain amount of tobacco, now under levy at Burkeville, Va., before Brevet Captain D.J. Connolly, Vol. Reserve Corps, Military Commissioner, at office of Military Commissioner, Burkeville, Va. June 19th 1867.

Evidence for the Plaintiffs

Samuel Harris, Freedman, being duly sworn, testified as follows:

"Mr Thomas Jennings sold a part of this tobacco to Mr Fatman. He always represented this tobacco as belonging to him. Less than two weeks before Mr Flippin levied on it, he (Jennings) told Mr Lacy in my hearing that he had hired Mr La Neve to prize the tobacco. About a week before I obtained the Judgment against him, Mr Lacy told Jennings that he had better sell the tobacco."

Mumford Smith, Freedman, being duly sworn testified as follows:
"Mr Thomas Jennings told me that he meant to pay me out of this tobacco when it was sold. The day that I obtained a judgment against him, he told me this. I had no idea that the tobacco belonged to any one else when the judgment was obtained. I worked for Jennings last year, as did also Samuel Harris:"

Thomas Jennings, being duly sworn, testified as follows.
"I made this crop of tobacco on Mr William Jennings place. I had no ready money to obtain supplies for my hands, and
