he gave me the Bill of sale except Samuel Harris and Mr McCafferty. I might have told Harris that Jennings would pay him when he sold his tobacco. I often had a sample of the tobacco before the Bill of sale was given. I do not remember showing a sample as Jennings tobacco after that time. I looked upon the Bill of sale as a Bona fide one. At the time the Bill of sale was given Jennings owed me more than the amount. I have paid Jennings no money since the Bill of sale was given.

Action of the Commissioner.

Owing to the conflicting testimony adduced in this case, Decision is reserved for ten days In the meantime the Papers and evidence in the case will be forwarded to the Comd'g Gen'l, for reviewal and such other action as he may think proper in the premises. The Tobacco will be taken charge of by the Constable of the District, properly housed and cared for at the expense of the party or parties interested in its disposition
