Buckingharm Co Virginia | That Defendant without proper authority seized and appropriated to his own use, a Mule which had been taken up as astray by Plaintiff, said Mile having been left in the road by the Federal Army in April 1865. | July 13/67 | It appears from the statements of the parties, that in April 1865, Mishaux took up as astray the Mule in question, said Mule having been abandoned by the Federal Army on its march to Appomattox Ho. At the time this occurred, the Mule was apparently worthless. Mishaux, after considerable expense and trouble succeeded in getting the Mule into a workable condition by September following, during the latter part of which month, Saunders seized said Mule, without, claiming any title in it but (as shown) for, the purpose of securing a claim for Rent, which he held against the Mother in-law of Mishaux. It was not shown that Mischaux had assumed or endorsed the claim alluded to. | That the property being Govt property, and Mishaux having taken up said mule as astray, he is entitled to possession, until orders from propert authority, are given for its final disposition. If the Mule belonged to Mishaux, Saunders had no right to seize it and appropriate it to the liquidation of a debt for which Mishaux was in no wise responsible. Ordered, That said Mule be returned to Mishaux within Three days from this date. |
