her statement differed from thiers in this particular, that she heard some one say, stop, stop, stop!  and then heard the shooting.  It was tried to be shown, that he had he threatened to kill anyone who should try to arrest him It was not done, He had said he would die sooner than go to jail. The inquest showed that he had rec'd a shot under the left shoulder, that it passed through the heart and body and out at the breast. The magistrate pronounced it a case of "justifiable homicide."  The authorities cited to sustain this by the defence, an American Crime Law Wharton, Second ed. p 398 and 400.  Mayo's Guide 358., 1st Russell on Crime 517.  I have very little to add, this murder may be legally justifiable, but I cannot think that it was necessary.
