Upon the indictment aforesaid and having fully heard the evidence of witnesses arguments of Counsel and instruction of the Court. Upon their oaths in Solemn form do say. We the jury find the prisoner guilty in Manner and form as charged in the Indictment of unlawful shooting & fixed his fine at one cent: and Twelve hours imprisonment in the County Jail.

The court doth order that the Prisoner be released from Jail upon the payment of the fine and all costs of this prosecution, Chastain White this day appeasing and Entering himself as security for the payment of the same the Court doth order that the Prisoner be discharged from Prison on tomorrow.

The following is a copy of the instruction delivered by the Court in this prosecution.

That if they shall believe from the evidence that when the prisoner shot Jacob Powell the said Jacob Powell, was not pursuing the prisoner and not menacing him with any danger, and that the prisoner had no reason to believe that the said Jacob Powell was menacing him with any danger or bodily harm, then that the shooting of the said Jacob Powell by the prisoner was malicious Shooting, or unlawful shooting at the least.
