shot Jones. Ella Smith was recalled and positively denied ever telling the last witness or any one else that she did not know who it was that shot Peyton Jones. Margaret Jordan testified that she heard Ella Smith tell Phillis. (as above) Phillis was again recalled and swore positively that Ella Smith alias Lizzie Jackson did say that "she was not positive about who shot Jones" - She then further testified that she saw the man who shot Jones, that the man who shot Peyton Jones wore a long coat and dark pantaloons, that she had never seen him since.
In order to convince you or to convince any one, else that Ella and Margaret Smith did tell the truth, allow me to certify that on the morning of the 12th of August 1868, I, in my office capacity as Sub Assis't Commiss'r. of the Bureau proceeded to the Old Market where I found Peyton Jones in the Police Station suffering with paralyses of the lower extremities, evidently cause by a gun shot wound received from some, to me at that time unknown.
