and Mr. Porter - but which he failed to prove - to the satisfaction of the Court - and second - on the ground that he had rented the land on which the calves were kept - This latter assumption is an error - as the Contract exhibits - For he merely had the privilege of the grazing land - on condition that he should fence it - and even this condition he failed to comply with Under the circumstances I do not see - how the Court could have rendered any other decision than the one on record -
