Sir,
I have the honor to call your attention to the case of James L. Watson charged with feloniously and unlawfully killing William Medley, colored, on the 14th day of November 1866, in Rockbridge County, which case was heard before a called court held for Rockbridge County, at the Court House on the 22d of November 1866, present William White, Henry M. Hatcher, James G. Updike, Samuel Cowan and John W. Mackey, gentlemen justices. Henry M. Hatcher being chosen to preside. This court was continued by adjournment until the 24th day of November 1866 β€” and on that day the same justices being present the following order was made by the same- viz: β€” "On consideration the Court is of opinion that the said James L. Watson be not further tried for the said offence and he is ordered to be discharged from custody β€” and the said James L. Watson was thereupon discharged.-

I respectfully represent that the above order and decision of the said called court was against and contrary to the evidence and the weight of the evidence which was heard by the same, and that the duty of the said court under the law and the evidence would have been to have sent on the prisoner for trial, and that the
