Benjamin Hatcher, being duly sworn, doth depose and say that he was appointed Executor of the will of late Thomas Howlett, deceased.

The will was contested, which prolonged the time of settling the affairs of the Estate.  I sold the Land for the Sum of ($4,800) four thousand eight hundred Dollars; my son became purchaser thereof, through the instigation of his uncle.  In the year 1860.  In as ready to convey the Freedmen, North.  They begged to remain until the Spring.  In the spring the War broke out, and it was therefore impossible to remove them then.  In the mean time my brother had died at the South and then my son was desirous of selling the Land, and in accordance with his wishes I sold the Land for him.  C.C. McRae was employed by the heirs as their counsellor; he contented that he ought to have the proceeds of the Land, in hand and that he would be responsible for it;
