In the year one thousand eight hundred and fifty nine Ex. Govr. Wise entered into a verbal, contingent contract with me for the purchase of the estate known as Rolleston: by which it was agreed that the principal might be remaining unpaid for a definite period; but that it should draw interest from the day of delivery of the premises and that this int. should be payable quarterly "per anum": that no deed should be given but that it should be witheld as security.

At the date of this contract Govr. Wise was indebted to me in a considerable sum of money; he was allowed to enter and occupy the premises immediately without his paying the debt he then owed; or paying or securing to be paid the amt for the land purchase: subsequently hes assigned to me two bonds each for the sum of six thousand dollars payable, one, on the 1st of Jany. 1861, and the other on the 1st of Jany. 1862 both bearing interest from its date of execution, to wit the 1st of Jany
