If in the opinion of Lt Keatly this property is "abandoned" according to the definition of "abandoned property" in 1st Dis't of Act of Congress of 1865 which provides that "property real or personal shall be regarded as abandoned property when the lawful owner shall be voluntarily absent therefrom, and engaged either in arms or otherwise in aiding or encouraging the rebellion. It will be retained if not it will be returned to the applicant.
